Welcome to Designwise, operated by designtype.co. These Terms of Service govern your access to and use of our website, platform, and all services offered by Designwise. By accessing, browsing, or using Designwise, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use our services.

1. Acceptance of Terms

By using Designwise, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy. These Terms constitute a binding agreement between you and designtype.co. If you do not accept these Terms, you must immediately cease accessing and using our services.

Your continued use of Designwise following any modification to these Terms constitutes your acceptance of such modifications. We reserve the right to update these Terms at any time, and it is your responsibility to review them periodically for changes. Your use of the service after any changes have been posted constitutes your acceptance of the revised Terms.

2. Description of Service

Designwise is a digital platform designed to provide design-related tools, resources, information, and guidance. Our services include but are not limited to design consultations, design theory education, design trend analysis, and access to design-related content and materials.

The specific features and functionality of Designwise may change from time to time as we update and improve our platform. We make no guarantee that any particular feature will remain available or unchanged. We reserve the right to modify, suspend, or discontinue any aspect of Designwise at our sole discretion, with or without notice.

3. User Accounts

To access certain features of Designwise, you may be required to create a user account. When creating an account, you agree to provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and password, and you agree to accept full responsibility for all activities that occur under your account.

You agree not to use your account for any unlawful or prohibited purposes, and not to interfere with or disrupt the normal flow of dialogue in our community. Designwise reserves the right to suspend or terminate any account that violates these Terms or engages in conduct we deem inappropriate, without liability to you.

You are responsible for maintaining the security of your account. If you become aware of any unauthorized use of your account, you must notify us immediately at the contact information provided at the end of these Terms.

4. Payment Terms

Subscription Fee

Designwise offers subscription-based access to its premium services. The current subscription fee is four hundred dollars ($400) per calendar month. Billing occurs on a monthly basis, and charges will be applied to the payment method you provide during account setup.

The monthly fee will be automatically charged on the same date each month. You authorize Designwise and designtype.co to charge your payment method for all fees and charges that you incur. If your payment method is declined, you remain responsible for any amounts due. If your account remains unpaid for thirty (30) days, Designwise may suspend your account access without further notice.

Cancellation Policy

You may cancel your Designwise subscription at any time through your account settings or by contacting our support team. Cancellation requests submitted before the monthly billing date will take effect at the end of your current billing cycle. No refunds will be issued for the current billing month if you cancel after your monthly charge has been processed.

Upon cancellation, your access to Designwise services will terminate at the end of your paid subscription period. You will not receive access to future months, and no credits or refunds will be applied to any subsequent billing periods.

If you cancel your subscription, your account data and saved projects may be retained by Designwise for a limited period as specified in our Privacy Policy, after which they may be deleted.

Refund Policy

Designwise operates on a non-refundable subscription model. Once a monthly subscription fee has been charged to your payment method, it is non-refundable under normal circumstances. This means that you cannot request a refund for the current billing month under any circumstances.

The only exception to this non-refundable policy is if a charge is made in error (such as duplicate billing or charges after account cancellation has been confirmed). In such cases, you must contact us within thirty (30) days of the erroneous charge with documentation supporting your claim. We will investigate and, if the error is confirmed, will issue a refund to your original payment method within thirty (30) business days.

Refund requests made after thirty (30) days from the date of charge will not be accepted.

5. Intellectual Property

All content provided by Designwise, including but not limited to text, graphics, logos, images, videos, design templates, design theory materials, and all other materials on the platform, are the exclusive property of designtype.co or used with permission from the appropriate rights holders. These materials are protected by applicable copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to access and use Designwise for your personal, non-commercial use only, subject to these Terms. This license does not permit you to download, save, copy, distribute, transmit, modify, or create derivative works from any content on Designwise without prior written permission from designtype.co, except as expressly permitted by applicable law.

Any content you create, upload, or submit to Designwise remains your intellectual property. However, by submitting content to Designwise, you grant us a non-exclusive, worldwide, royalty-free license to use, display, modify, and distribute your content for the purposes of operating and improving our platform. This grant does not transfer ownership of your content to Designwise.

You may not use any of our service marks, trademarks, logos, or company names without express written consent from designtype.co. You agree not to remove or alter any copyright, trademark, or other proprietary notices on our platform.

6. Limitation of Liability

To the fullest extent permitted by law, Designwise and designtype.co, including their officers, directors, employees, and agents, shall not be liable to you for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or use, arising out of or in connection with your use of Designwise, even if we have been advised of the possibility of such damages.

In no event shall the total liability of Designwise for all claims arising from or relating to your use of our services exceed the total amount you have paid to Designwise in the twelve (12) months preceding the claim. If you have not paid any fees to Designwise, your sole remedy for dissatisfaction with our services is to discontinue using them.

Some jurisdictions do not allow the exclusion of certain types of damages, so the above limitations may not apply in your location. In such cases, liability will be limited to the maximum extent permitted by law.

Designwise makes no guarantee, warranty, or representation that use of our platform will result in any particular outcome, including but not limited to improved design skills, successful design projects, increased client satisfaction, business growth, or any measurable benefit. Results vary significantly based on individual skill, application, market conditions, and numerous other factors beyond Designwise's control.

You acknowledge that your use of Designwise and any outcomes resulting from such use are entirely at your own risk. You are solely responsible for evaluating the appropriateness and accuracy of any information provided through our platform for your specific situation.

Third-Party Content Disclaimer

Designwise may include links to third-party websites, resources, or content. We do not endorse, control, or assume responsibility for the accuracy, legality, or appropriateness of any third-party content.
